Product Return Policy


Cancellation

All Purchases, including online, telephone, fax, mail, or in person whether written or verbal cannot be cancelled without reasonable cause by Purchaser without the express consent of the Seller. Cancellation(s) of purchases orders must be in written form and e-mailed to Toboa Energy Resources LLC prior to start of construction of equipment or shipment for acceptance. Should Purchaser attempt to cancel an order without cause, Purchaser shall reimburse Seller against all loss occasioned by such cancellation, including loss of anticipatory profits and liability for commitments made by Seller relating to the Purchase Order and shall purchase any existing inventory and work in process which Seller has in its possession to fulfill Seller’s existing orders for Purchaser at the time of cancellation. As used herein, “cause” shall mean a material breach of Seller’s duties and obligations hereunder and the failure to cure such breach after Purchaser notifies Seller of such breach and affords Seller a reasonable time to cure same. It is the purchaser’s responsibility to confirm an ordered items shipment date before ordering. Orders placed for quick shipment next day or second day service that are not in stock and subsequently canceled by purchaser due to availability will incur a 20% or more depending upon cost incurred of order surcharge plus any cost to cancel with manufacturer.

Returns of items purchased

It is our goal to make your shopping experience as care free and productive as possible. We understand that things may change, and normally allow standard items purchased from Toboa Energy Resources LLC website to be returned for a credit or a refund if needed.

Restocking fees for returned goods

When Toboa Energy Resources agrees to accept an item for return customers are required to pay restocking. When returning a product customers are to basically asking us to take back a product that was ordered from our vendor on their behalf. In doing so, Toboa Energy Resources LLC must hold it in inventory for an indefinite amount of time at our expense, pay our vendor for it and trust we will be able to sell it again or return it at our expense to said vendor and incur a restocking fee. In those instances we require restocking fees to cover sum of the risk but not all of the carrying cost or risk associated with holding the product. A maximum of twenty percent of order fee could apply to cover the long term risk associated with a mistake in purchase that a customer returning an item is asking us to accept. Returned equipment must be inspected, repacked, tested, etc… to be able to be sold “as new”.

Normally, Toboa Energy Resources LLC and its manufacturers will try not to incur restocking fees when we agree to returns to help customers who have made errors in item type, fit, form, function or are in a hurry and buy something else and no longer need the item purchased. However, it is customers full responsibility for determining products fit, form, function and delivery based on available information. Ignoring due diligence is not a sufficient reason for return.

Items not allowed for return for credit

  1. Special order custom built to order items.
  2. Items damaged through return shipping, misuse, or use.
  3. Items more than 14 days from day of receipt unless manufacturer warranty.
  4. Items that have been modified in any way.
  5. Items that tags, markings, logos, codes or instructions have been removed.

Returning products or exchanging items

Send us your request via e-mail, Toboa Energy will determine if your item can be returned or exchanged. Toboa Energy Resources LLC cannot accept responsibility for damage incurred after a customer has signed for the merchandise in good condition. In addition, some items are non-returnable. Returns of “Factory Shipped” items will be subject up to 20% product restocking fee including applicable taxes, loss of shipping costs and manufacturers restocking depending upon circumstances and manufacture approval.

How long does it take to process a return for credit

In most instances 10 to 20 working days after return of goods. This time line is based upon our receiving the products back.

Return policy

Standard non build to order Items can be returned if approved and within 14 days of day delivery. A return goods authorization (RGA) number is required and issued by Toboa Energy Resources L.L.C. Refunds are given for the cost of product only less any restocking fees and shipping costs. After 14 days, the all items are subject solely to manufacturer’s warranty and must be authorized by a manufacturer customer service representative for disposition. Gas and diesel-powered items are not eligible for return for credit once they have been filled with liquids, fuel or oil. Any fueled or oil filled equipment are solely covered by manufacturer’s warranty only and must be handled according to manufacturer’s instructions when covered under warranty. In addition, some other items not mentioned herein may be non-returnable.

Damaged goods

If any goods should arrive at Purchaser’s destination in a damaged condition or should a shortage occur, Purchaser shall immediately report the damage or shortage to the delivering carrier and to Toboa Energy. Any loss or shortage occasioned by damage or otherwise occurring in transit will be for account of Purchaser. Allegedly defective goods or parts that are to be returned by Purchaser to a destination specified by Toboa Energy, require freight charges to be prepaid by Purchaser. All repairs and replacements are subject to verification and inspection by Toboa Energy Resources L.L.C. Toboa Energy Resources L.L.C. shall not be responsible for costs of deinstallation and reinstallation of goods or parts returned.

Return instructions

Purchaser must clearly label the product with information to identify the Purchaser and a Toboa Energy’s (RGA) Return Goods Authorization number. Purchaser should also include contact information and a written instructions with reason for return, or service. A base handling charge for repairs could apply for each product returned regardless of condition that it is in when returned for evaluation. All products being returned must be shipped prepaid to the Return address listed on this page. Quotations for repair and similar matters will be issued shortly after return. All products returned shall be considered abandoned by Purchaser and may be scrapped if the Purchaser renders no disposition instructions after 30 days from notification by written quotation. Toboa Energy Resources LLC does not warranty any repaired products under any circumstances. Products repaired and the repairs are the sole responsibility of the owner of the products. Products sent to Toboa Energy for evaluation will be returned upon request and at the owner’s expense.
